By using the Ask A Pharmacist app, including this Website (https://www.Ask A Pharmacist.co.uk) and our mobile and tablet applications (together, the Platform), you accept these terms and conditions in full, along with all other rules, policies and procedures that may be published by Ask A Pharmacist on the Platform or otherwise communicated to you from time to time by Ask A Pharmacist (together, the Terms & Conditions).
IF YOU DO NOT UNDERSTAND, ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS YOU ARE NOT AUTHORISED TO ACCESS OR USE PUSH AND YOU SHOULD EXIT THE PLATFORM AND CANCEL ANY APPOINTMENT IMMEDIATELY.
Ask A Pharmacist reserves the right to suspend or terminate your access to the Platform at any time, without notice and without liability, if it reasonably determines you have breached these Terms and Conditions.
Ask A Pharmacist is NOT to be used in an EMERGENCY situation
IF YOU BELIEVE THAT YOU OR THE PERSON YOU ARE ASSISTING IS IN AN URGENT OR EMERGENCY SITUATION YOU SHOULD IMMEDIATELY DIAL 999 OR SEEK ALTERNATIVE EMERGENCY MEDICAL SERVICES.
YOU SHOULD CALL 999 in a critical or life-threatening situation, such as if someone has:
severe bleeding and it can`t be stopped
severe chest pain
loss of consciousness
acute confused states and fits which aren™t stopping
or if you believe someone is having a heart attack or stroke.
1. Ask A Pharmacist OVERVIEW
The Platform is owned by Ask A Pharmacist Limited (Ask A Pharmacist,our, us, we), a company registered in England (company number 10838456).
The Platform is operated and managed under license from Ask A Pharmacist Ltd by My Direct Pharmacy, a registered pharmacy (Registration 1125509) and company (Mastermedicine Ltd 08799390 Unit 19, Redbridge Enterprise Centre, Ilford, Essex, IG1 1TY).
You can check the pharmacy registration on the website at pharmacyregulation.org.
Ask A Pharmacist enables individuals in the United Kingdom (Customer, Customers, you, your, yourself) to connect in real time, via chat, instant messaging and picture messaging, to participating pharmacists (all of whom are registered with the UK General Pharmaceutical Council: www.pharmacyregulation.org the GPhC) (the Pharmacists) via the Platform in order to gain qualified and professional medical advice.
Ask A Pharmacist may vary charges for any Services at any time, and changes will be notified to you in accordance with these Terms and Conditions.
You expressly understand, accept and agree that when using the Platform the Pharmacists are independent medical professionals that are individually responsible for the medical advice they offer to you via the Platform.
Ask A Pharmacist is a connective Platform that enables Customers to consult with Pharmacists on a private basis. Ask A Pharmacist will never automatically share your medical information or consultations with your NHS GP unless you instruct us otherwise.
Ask A Pharmacist will make all reasonable endeavours to connect you to Pharmacists, subject to minimum specification requirements which are determined by Ask A Pharmacist.
2. INFORMATION YOU PROVIDE
You accept and agree that any medical advice offered and/or diagnosis provided by a Pharmacist is based on your recall and description of the symptoms affecting you and/or by reliance on personal health data that you authorise us to obtain/that you provide to us by way of uploading such information to the Platform. A very significant part of the medical advice/diagnosis you may receive is therefore based on the information that you supply. It is entirely your responsibility to honestly present information when questioned in as much detail as possible. The information™s accuracy is paramount.
You warrant without exception that any information you provide is honest, legitimate and an accurate representation of your situation as you see it.
Medication is prescribed in accordance with information you provide to our prescribers through assessment questionnaires on the app. We therefore take no liability for loss or damage arising from our service or medication prescribed if you supply incorrect or incomplete information.
You will inform us or your doctor of any side effects of treatment and any other issues arising from treatments provided through the app.
You agree to inform your GP about medication supplied and advice given to you through the app.
We are not liable for damages which arise from your failure to inform your GP or other healthcare professional about treatment you receive from the app.
We are not liable for any damages which results from your failure to follow advice given on the app and within product information leaflets found inside medication.
You accept the advice that the app provides does not replace your GP and that you should consult with your GP and other healthcare professionals when you are advised and as need arises.
You undertake to read carefully all product packaging and patient information leaflets supplied with your medication.
In the event that you do not fully understand the questions in the assessment part of the app or are unsure how you should answer those questions or you do not fully understand the advice or information given to you on the app you will seek clarification from us via the chat facility or call back feature.
In the event your medicine appears to be damage or wrongly dispensed or delivery is delayed you agree to contact us as the first instance to seek advice and replacement as required.
Prescriptions are issued entirely at the discretion of the prescriber. The prescriber may contact you (rarely) if any further information is required. If the prescriber deems it not safe for a prescription to be issued you will be notified and all monies paid will be refunded within 5 days.
If any of these terms are held to be invalid or unenforceable then the validity and enforceability of the remaining provisions shall not be affected.
You give your consent for information about yourself, your health and your current medications including, but not limited to, the information you divulge as part of the questionnaire assessments to be viewed by My Direct Pharmacy employees and a You understand this information may be exchanged electronically.
Regulations require the identity of patients to be verified. This is achieved by checking data held by our payment processing company - PayPal. These checks will not affect your credit rating (a `soft search`).
We are not responsible for failure of third party companies` inability to deliver medicines to the correct address or within any particular time or date. You are responsible for signing for packages containing medicines but any signature provided by third parties at the delivery address given by yourself will be deemed to be receipt of the medicines.
You are responsible for providing valid credit or debit card details which may be charged. We reserve the right to not deliver medicines to you if your payment details have expired or are invalid in any way. In such cases we will attempt to contact you in such instances to enable you to provide updated information.
Payments are processed using our payments provider PayPal.
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998 and the EU GDPR directive.
Ask A Pharmacist Ltd and Mastermedicine Ltd (My Direct Pharmacy) and its directors shall not be liable for any losses or claims arising directly or indirectly from use of this app or its services except that this exclusion of liability does not apply to any damages in connection with death or personal injury caused by the negligence of Mastermedicine Ltd (My Direct Pharmacy) its directors or employees.
Your use of this app is governed by English Law and subject to the exclusive jurisdiction of the English courts.
PRESCRIPTION TREATMENTS AND PHARMACY PRODUCTS
All such information will be kept strictly confidential in line with the pharmacies Information Governance procedures. All prescription treatments provided require the pharmacy to keep records as stipulated by pharmacy law for a minimum of 2 years.
ORDERS, PAYMENTS & CANCELLATIONS
We may accept or refuse any order without giving a reason. Our confirmation email only confirms that we have received your order. There is no contract between you and us until we send you an invoice.
If you wish to cancel an order, you must inform us immediately via email to [email protected]
We will endeavour to return all monies paid within 5 days.

Order to be placed before 12pm to have your order dispatched the same day. Mon-Thur orders placed before 12pm will be delivered in 1-2 days. Friday orders placed before 12 pm will be delivered on Tuesday.Weekend orders will be delivered on Tuesday/Wednesday.

VIP same day delivery
Orders to be placed before 12pm to receive the same day (must be within 15 mile radius of IG1 1TY)
Same day deliveries are made in the evenings between 6-11pm Mon-Fri (excluding bank holidays) “ please be sure prior to placing the order that someone will be available to receive the order between these times. We will not refund delivery charges for failed delivery attempts.
If for any reason your items cannot be delivered the same day (i.e supply issues etc) you will be notified and all monies paid will be refunded.
All deliveries are subject to My Direct Pharmacy successfully receiving payment.
Delivery options exclude bank holidays and other public holidays.
We will deliver the goods in accordance with the delivery option selected by you during the order process. Any delivery timescales quoted to you are indicative only. Orders may be delivered in one or more packages.
Packages will require a signature on delivery.
All pharmacy purchases (that involve the completion of an online questionnaire) require additional approval and therefore may slow down delivery.
We strive to ensure our delivery targets are met but sadly when they`re not we`re unable to accept liability for any out of pocket expenses incurred for failed or delayed orders. You`re still entitled to your full statutory rights.
Depending on the location, contents and weight of your order, we may use a combination of couriers to deliver your order safely and on time.
We will deliver the goods in accordance with the delivery option selected by you during the order process. Any delivery timescales quoted to you are indicative only. Orders may be delivered in one or more packages.
We make every effort to deliver goods within the estimated dispatch timescales; however, delays are occasionally inevitable due to unforeseen factors. We are under no liability for any delay or failure to deliver products within estimated timescales caused by circumstances beyond our reasonable control. However, in accordance with the Consumer Contracts Regulations, all orders will be fulfilled within a maximum of 30 days or a full refund will be issued

Please note, this does not affect your legal rights. You have the same rights as any consumer under The Sale of Goods Act 1979 (and any amendments to it), the Sale and Supply of Goods and Services Regulations 2002, and any other consumer laws that might apply to contracts.
We are unfortunately unable to reimburse for any costs associated with returning your item(s).
There are no costs to the user for using the Ask A Pharmacist app.
5. PHARMACISTS AND CHOICE
You may not choose the Pharmacist to which you are connected unless Ask A Pharmacist provides these options to you on its Platform, which it may do from time to time at its sole discretion. Ask A Pharmacist does not make any guarantee whatsoever as to the availability of any single Pharmacist at any time.
Ask A Pharmacist does not make any representation or give any warranties regarding the Pharmacists™ training or skill, although we do make appropriate checks to ensure that pharmacists providing advice through the app are genuine and registered with the General Pharmaceutical Council. You can check the registration status of any pharmacist by entering their registration number (next to the pharmacist name) on
6. YOUR Ask A Pharmacist ACCOUNT
In order to access the Platform and the Services you represent and warrant that you are at least sixteen (18) years of age and possess the legal right, capacity and ability, on your own behalf to accept and agree to these Terms and Conditions.
You agree to create your Ask A Pharmacist account (Account) accurately and truthfully, including but not limited to your name or initials, email address and password.
Your Account details are personal to you and you are solely responsible for maintaining their confidentiality, as you remain liable for all activity that occurs under your Account. You agree to prohibit anyone else from using your Account and you agree immediately to notify Ask A Pharmacist of any actual or suspected unauthorised use of your Account or any other security concerns, howsoever arising, immediately upon your becoming aware of them. Unless and until you notify us of any suspicious activity or security concerns we will assume all actions taken linked to your Account to be authorised by you.
In order to determine your compliance with these Terms and Conditions we reserve the right to monitor your access to and use of the Platform and the Services. Ask A Pharmacist may, at its sole discretion, deny access to the Platform and/or refuse to provide Services in the case of actual or suspected misuse of the Platform and/or Services or for any actual, attempted or suspected non-compliance with these Terms and Conditions, including but not limited to security concerns or potential infringement of intellectual property rights.
Ask A Pharmacist reserves the right to refuse access to the Platform to anyone, at its sole discretion from time to time, whether or not the user has previously successfully registered, visited or used any Services.
The regulations stipulate that we may not consult with, triage or give medical advice to children or young persons under the age of 16 unless accompanied by a parent with a valid form photo ID (Passport or driving licence).
Ask A Pharmacist may contact you by telephone, post or email to verify your Account information. Ask A Pharmacist may request further information from you, which you agree to provide, in order to ensure you have not fraudulently created your Account.
If you do not provide any such information in the manner requested within seven (7) working days of the request, Ask A Pharmacist reserves the right to suspend, discontinue or deny your access to and use of the Platform and Services until such time as the information is provided to Ask A Pharmacist™s reasonable satisfaction.
8. MODIFICATIONS TO TERMS AND CONDITIONS
Ask A Pharmacist reserves the right to modify the Terms and Conditions periodically, for any reason. We will post a copy of the updated Terms and Conditions on the Platform prior to any change becoming effective; if we make any material changes (including any change to our Costs) we will notify you prior to the change becoming effective. Any such revision or change will be binding and effective immediately on posting the revised Terms and Conditions on the Platform and you should cease use of the Platform if you do not agree to any such change.
The most current version of these Terms and Conditions can be accessed at any time by selecting the Terms link in the footer of the website or the Terms & Conditions section of the mobile application. Any new version of these Terms and Conditions will, once published, supersede any previous version.
9. LIMITATIONS ON USE
You agree that you will not, and will not permit anyone else to:
a) use the Platform or Services in any unlawful way and/or for any unlawful purpose;
b) post or transmit a message (written, verbal or via video) under a false name or use the network resources of Ask A Pharmacist to impersonate another person or misrepresent authorisation to act on behalf of others (including but not limited to Pharmacists. All messages transmitted via Ask A Pharmacist and the Platform should correctly identify the sender and you may not attempt to alter the origin of email messages or postings;
c) allow another person or entity to use your Account, username or password;
d) market, promote or solicit the Services except as expressly permitted by these Terms and Conditions;
e) distribute chain letters or unsolicited bulk electronic mail ("spamming") via the Platform, to Ask A Pharmacist or to any third party allegedly on behalf of Ask A Pharmacist;
f) attempt to undermine the security or integrity of computing systems or networks of Ask A Pharmacist, its Platform or any sites or platforms accessed through or via the Platform, and you must not attempt to gain unauthorised access;
g) harvest or collect data about any other individual who uses the Platform;
h) post or transmit any data, materials, content or information which is threatening, false, misleading, abusive, defamatory, derogatory, pornographic or profane, or that contains or promotes any virus, worm, Trojan horse, time bomb or other computer programming or code that is designed or intended to damage, destroy, intercept, download, interfere, manipulate or otherwise interrupt or expropriate the Platform or the Services;
i) tamper, hack, spoof, copy, modify or otherwise corrupt the administration, security or proper function of the Platform or the Services. You will not use robots or scripts with the Platform;
j) attempt to reverse engineer, reverse assemble, reverse compile, decompile, disassemble, translate or otherwise alter, defraud or create false results from any executable code or information on or received by this Platform. You agree to have anti-virus and/or anti-spyware software running that is set to override the Internet browser™s cookie setting.
You further agree that any information you provide or use on the Platform, and your use of the Platform or Services will not infringe or facilitate infringement of any copyright, patent, trade mark, trade secret or other proprietary, publicity or privacy rights of any party.
Ask A Pharmacist maintains the right to delete any information provided by you that it deems in its sole discretion fraudulent, abusive, defamatory, obscene or in violation of a copyright, trade mark or other intellectual property or ownership right of any other person and to suspend your access to the Platform in such circumstances.
Ask A Pharmacist reserves the right to terminate any Account without reason.
11. OPERATIONAL FUNCTIONALITY
Ask A Pharmacist reserves complete discretion with respect to the operation of the Platform and Services and may alter, withdraw, suspend or discontinue any functionality or feature of the Platform and/or Services at any time. Ask A Pharmacist is not responsible for transmission errors or corruption or compromise of information carried over local or interchange telecommunications carriers.
12. TEMPORARY USE LICENCE GRANTED
For the duration only of being logged into your Account from time to time, and subject to your compliance with these Terms and Conditions, you are hereby granted a non-exclusive, non-transferable, temporary licence to use the Platform and the Services solely for personal, non-commercial use. You may not sell, assign, sublicense, grant a security interest in or otherwise attempt to transfer any right in the Platform (including its software and documentation), create derivative works based on or in any manner commercially exploit the Platform or the Services, in whole or in part.
The Customer is granted a licence to download or stream a copy of the Ask A Pharmacist app (and any documents provided on or in relation to the Platform or Services) onto a mobile and/or tablet device and to view, use and display the app on such device(s) for its personal purposes only, the terms of which are set out in the end user licence agreement. Customers must accept when downloading the app. The Customer may not copy or otherwise use such information to create derivative works.
You must not misuse our site by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Platform, the server on which our website, app or related materials are stored or any server, computer or database connected to the Platform. You must not attack our site or app via a denial-of-service attack or a distributed denial-of-service attack; by breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.
You may link to our website home page provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site on any website that is not owned by you. We reserve the right to withdraw linking permission at any time.
Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

14. INTELLECTUAL PROPERTY
Ask A Pharmacist (or its licensors) retains all right, title and interest in and to the Ask A Pharmacist name, the Services and any information, products, documentation, software or other materials used in relation to or made available via the Platform, along with any patent, copyright, trade secret, trade mark, service mark or other intellectual property right in any of the foregoing in any territory.
You will not store, copy, modify, lease, loan, sell, distribute, transfer, display, reverse engineer, reverse assemble or otherwise attempt to discover any programming code or any source code used in or with the Platform (save to the extent required for you to make back-up copies of such software or arrange its inter-operability with other packages).
You acknowledge that violations (as determined at Ask A Pharmacist™s sole discretion) of these intellectual property protections may lead to formal legal action. Save as set out in these Terms and Conditions you have no right to use any of the intellectual property rights associated with the Platform without the prior written consent of Ask A Pharmacist.
15. INTERNATIONAL USE
The Platform and the Services are designed for and intended for users in the United Kingdom only, unless exclusively specified by Ask A Pharmacist. Ask A Pharmacist makes no representation that the information and/or the services provided via the Platform are applicable to, appropriate for or available outside the United Kingdom. Accessing the Platform Services from territories where any content and/or Services may be illegal is strictly prohibited.
16. LEGAL NOTICES AND DISCLAIMERS
Medical Disclaimers: Ask A Pharmacist makes no representation or warranty as to the content of any treatment response from any Pharmacist; Pharmacists are independent contractors and not employees of Ask A Pharmacist and any views expressed or advice provided by Pharmacists are not necessarily endorsed by Ask A Pharmacist. You and your Pharmacist are solely responsible for all information provided and/or advice given via the Platform.
Always seek the advice of a doctor or other qualified healthcare provider regarding any medical concerns - and before starting, stopping or modifying any treatment or medication - even if you have already obtained medical advice via or read relevant material on the Platform.
Ask A Pharmacist does not guarantee that a video/chat/picture message consultation is the best course of accessing advice or indeed the appropriate course of treatment for your particular healthcare concern or medical issue. Furthermore, Ask A Pharmacist is not a substitute for your primary care provider. You agree to contact your GP immediately should your condition change or your symptoms worsen (if you are not registered with a UK doctor you agree to contact your local walk-in centre or hospital for advice). If you require urgent care, you should contact your nearest emergency services centre immediately.
Content Disclaimers: No information whatsoever or howsoever found on or via this Platform (other than advice provided by a Pharmacist in a consultation) should be relied on as medical advice, professional or otherwise. Nothing contained on this Platform should be construed, directly or indirectly, as the practice of medicine by Ask A Pharmacist, which only arranges the service of connecting you to a Pharmacist. Should there be an issue with any of the medical services you receive from Pharmacists via the Platform, you can Contact Us.
Ask A Pharmacist makes no warranties or representations as to the accuracy of articles and other material published on the Platform and assumes no responsibility for any consequences relating directly or indirectly to any action or inaction you take based upon such material.
General Disclaimers: We do not guarantee that the Platform will be secure or free from bugs or viruses.
You are responsible for configuring your information technology and computer programmes in order to access the Platform. You should use your own virus protection software.
You are also responsible for ensuring that all persons who access the Platform through your internet connection are aware of and comply with these Terms and Conditions.
Ask A Pharmacist MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT: THE SATISFACTION OF GOVERNMENT REGULATIONS REQUIRING DISCLOSURE OF INFORMATION ON PRESCRIPTION DRUG PRODUCTS; OR ANY TREATMENT, ACTION OR APPLICATION OR PREPARATION OF MEDICATION BASED ON INFORMATION OFFERED OR PROVIDED THROUGH THE Ask A Pharmacist PLATFORM OR SERVICES.
Ask A Pharmacist does not endorse the promotions, products or services of any third parties, nor does it warrant or validate the accuracy of any third party advertisements, promotions, communications or other materials. Ask A Pharmacist does not assume any responsibility or liability for the accuracy of information contained on any third party web sites.
17. SERVICE RELIABILITY AND WARRANTIES
Ask A Pharmacist makes no warranty that the Platform or the Services will meet your requirements or that the Services will be uninterrupted, 100% secure or error-free, or that defects, if any, will be corrected. Ask A Pharmacist is not responsible for transmission errors or any corruption or compromise of data carried over local or interchange telecommunication carriers.
Ask A Pharmacist will take all reasonable precautions to protect against failure of its equipment and software and will perform regular back-ups of all data stored. The Customer acknowledges and agrees that in the event restoration of data from backup is necessary, it may take several days to complete such restoration of data and resume operation of the Platform and/or the Services.
18. LIMITATION OF LIABILITY
We will not be liable to any Customer for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
inability to use the Platform; or
use of or reliance on any content or advice given or not given on the Platform.
Please note that we only provide the Platform for domestic and private use. You may not use the Platform or the Services for any commercial or business purposes; if you do use the Platform or the Services for any commercial purpose Ask A Pharmacist has no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Ask A Pharmacist assumes no responsibility for the content of websites linked on the Platform. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from any Customer™s use of such sites.
19. TERMINATION AND SURVIVAL
OUR RIGHT TO TERMINATE
Ask A Pharmacist may terminate all access to the Platform or the Services at any time, without notice.
Ask A Pharmacist will advise you of any termination via the contact email held as part of your Account.
YOUR RIGHT TO TERMINATE
You may cease using the Platform and/or have your Account suspended from usage/availability at any time.
Upon termination of your Account for whatever reason, Ask A Pharmacist has the right to delete all data, files or other information relating to you that it stores or controls for any reason, subject to UK law concerning the keeping and maintenance of medical/patient records and also data protection and the secure destruction of personal data.
20. DELIVERY OF SERVICES
Ask A Pharmacist is in no way responsible for pricing or delivery of services you receive via the app.
In the event of any complaint or dispute you should first Contact Us and fully inform us of the issues surrounding your dispute in an open and engaged manner.
Any complaints with regards to a Pharmacists professional behaviour or fitness to practice should be taken up with the General Pharmaceutical Council using the following link
22. NO THIRD PARTY RIGHTS
Nobody else has any rights under these Terms and Conditions. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
We may transfer our rights and obligations under these Terms and Conditions to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights.
25. APPLICABLE LAW
These Terms and Conditions are governed by English law and you can bring legal proceedings in respect of the Platform or the Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
If a court finds part of these Terms and Conditions illegal for any reason, the rest will continue in force. Each of the clauses operates separately; if any court or relevant authority decides that any clause is unlawful, the remaining clauses will remain in full force and effect.
Even if we delay in enforcing any of these Terms and Conditions, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms and Conditions, or if we delay in taking steps against you in respect of your breaching these Terms and Conditions, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Services, we can still require you to make the payment at a later date.

Please note that by sending us ideas, artwork, computer code or creative materials you assign all copyright and other intellectual property rights in such materials to Ask A Pharmacist; you also waive your moral rights in respect of the same. Ask A Pharmacist shall have the right to use any such creative materials for any lawful purpose, including but not limited to reproduction, disclosure and publishing, without any compensation to you.
The rights in this clause do not apply to any personal information you submit as part of your other personal information held in your Account.
